joins us now and they say the background checks are more than taxi drivers. >> oober said it happened more than seven years ago. after being booked for reckless driving, this is him. according to the 2004 arrest report obtained by the investigative unit, he's described as showing a disregard for the safety of others driving at a high rate of speed with three children and wife in the vehicle. he is being charged with vehicular manslaughter with gross negligence and failure to yield after police say the driver hit and killed a six-year-old on new years eve in san francisco. nearly a decade ago, a reckless driving arrest took place on a florida highway. authorities witnessed the 57-year-old pulling into oncoming traffic to pass several cars and driving in an excess of 100 miles per hour in a 45. but according to oober, he had a

clean background check when he became a partner. they use a consumer reporting agency that told us california law prevents them from reporting the arrest to oober because it is more than seven years old. in a recent e-mail oober said the background checks are safer and backer than the agency that oversees taxis in san francisco. their spokesperson told us cab drivers must have no prior convictions, and background checks go back for the entire adult life. there is no limit, seven years would have shown up. oober says drivers must undergo quality reviews which they argue separates them from taxi cabs. >> very interesting report. thank you. if you have a tip for elyce or anyone else, we urge you to give us a call at 888-996-tips or

thinking? they are asking that, jessica. tonight i'm learning about the man that lived inside the home. i'm told tonight he was a vietnam veteran and the device that the family found was located in the front of his apartment. no one cold tell me tonight exactly what that device was. we know that removing it was a problem. parts of this neighborhood frozen in time and quite literally shattered when some sort of explosive device blew out windows, damaged walls and set off car alarms. it was an explosion set off intentionally by san francisco's bomb squad. >> i walked down the street all the time. i could have been right here when it happened. >> reporter: when the ploethe e happened before 9:00 last night. police say it began with a call around 6:00 when a family member found something suspicious. >> in that residence, someone passed away that lived there. family members were there cleaning out the residence, and

they encountered this device. >> the san francisco bomb squad decided it was too risky to move it, and that's when they made the decision to attempt a controlled detonation inside the home. >> the primary goal in this incident was public safety. we want to make sure there were no citizens injured. >> no one was injured, but the plan backfired with a blast much bigger than they expected. several windows shattered, car alarms began booming and the grocery store next door was heavily damaged. >> in other situations, there may be where we could move it, but every situation is different and in this one, the best outcome for everyone is to leave it there. >> tonight, those who live there are questioning the move they made because the aftermath was overwhelming. >> take that somewhere else, scared the crap out of my roommate. >> a lot of folks in this neighborhood shaken up, but the good news, no one was hurt. flag mtds from the device will

did the pets make them targets? a pets mart employee used a job to identify homes to burglarize and the key to her strategy, the family dog. jodi hernandez joins us live from san carlos, jodi? >> at least eight separate pet owners who boarded their pooches at this pets mart ended up becoming victims of burglary after a worker identified those families as prime targets. 10 year old joey shows us where his prized autographed football once sat in his bedroom. the boy's sports memorabilia and

$35,000 worth of belongings were sold while they were on summer vacation last august. >> mostly they stole my wife's jewelry, but they also stole some sports memorabilia. it was very surprising. you can't believe that it's actually happened. it's disappointing. >> turns out, one of the suspects, who has now been arrested had ties to this pets mart in san carlos where the victim's family boarded their dog andy while on vacation. investigators say 24-year-old ashley kirk worked at the store and was filtering information to her husband, ramos, about the family and at least seven others. >> obviously knowing they wouldn't be there, their dogs wouldn't be there, these were prime opportunities, i gus, for burglaries. unfortunately, that's what they were doing. >> reporter: the san jose couple was arrested monday charged with

eight counts of residential burglary, two counts of auto theft and one count of possessing stolen property. >> they were stealing any number of items, everything that people would keep in their homes from jewelry to cash, sports memorabilia, electronics, anything they could steal, they took. >> reporter: the family says some of the items simply can't be replaced, and they can't believe andy's stay at pets mart may have been what lead to such losses. >> disappointing. it's wrong. i'm happy that they were caught. i'm happy that they have been charged. it's not fair. >> reporter: now pets mart says they are deeply concerned when they learned about these allegations. they issued this statement late today saying, we fully cooperated with authorities throughout their investigation and we reached out to every pet owner impacted to see how we could help them during this time. while investigators have identified at least eight victims, they say there could be more.

reporting live in san carlos, i'm jodi hernandez, nbc bay area news. thank you. there might be a new look for sjdp. a san jose city counsel committee today agreed to look into funding these cameras and storing the videos. it will work with the police department to develop how and when the cameras will be used as officers patrol the streets. san jose police have conducted research when they rolled out a pilot program in 2011. officers say it was a success but cost is a major issue. tonight, investigators continue looking for clues in 13 arsons that terrorized a neighborhood east of downtown san jose. they were at the scene of a home of an elderly couple that lost everything. damian trujillo was with the family today and he is outside their home. what a huge loss because they didn't have insurance. >> reporter: they don't have anything else, besides the clothes on their back, jessica. the serial arsonist has not

struck in three days. police are trying to track them. he struck at this home over the weekend here in san jose. tonight, the victims of that arson, the lavina family have a message. >> you're doing a great job and i appreciate your hard work, you know. we're very strapped right now. >> reporter: i can't imagine. today firefighters from station one returned to the home to tie up some loose ends. this is where the san jose couple lived for 45 years until an arsonist struck last weekend destroying it. >> taking one day at a time. we got out of there with the clothes on our back and alive. >> reporter: a neighbor woke up the elderly couple just before the roof collapsed and police believe the man in this sketch is the person who set that fire. >> it's still very unsettling.

we don't know where we'll go. >> reporter: rebuilding their lost home could be a tougher proposition for this family, however. they say their insurance company recently switched the premium from a monthly bill to an annual one, a switch they couldn't afford on their limited fixed income so the insurance company cancelled their policy. >> unfortunately, and lucky i still have my parents, even though their house is gone. >> reporter: the couple's son is trying to raise funds for his parents through friends and online donations, but his parents say despite the loss, they can't find room to hate the person who did it. >> obviously, he has emotional and mental issues, and you can't, you know, hate somebody who is mentally ill. >> reporter: while they don't hate him, they do hope he lit his last fire. >> he needs to turn himself in and get some help, because, you know, he nearly -- he could have nearly killed my parents.

>> i wish it hadn't happened to me. >> reporter: a painful reality for a couple who barely made it out alive. the son so far raised $4,000 through his online campaign. we talked to our expert, criminal psychologist how maybe why this suspect has not struck in the last few days. it may be that he knows police are on to him, maybe that sketch is actually a pretty good sketch, or maybe he realizes that he could easily hurt someone and he doesn't want to do that. he came awfully close with this family and also, maybe he realizes the consequences if he actually kills somebody. then there is the other end of the spectrum, maybe he's laying low for a few months before he strikes again. according to dr. leonard donk. >> we hope it all stops. thank you. in the east bay, now, another boy has come forward in the case of livermore golf coach accused of molesting some students. that led the prosecutor to charge the instructor with ten

additional counts. there are now three alleged victims under the age of 17. he appeared in court today but did not enter a plea. there are 75 counts against him. he was a popular coach who worked with kids at several courses around the country and the bay area, including la las picedas. tour buses are no longer allowed in the neighborhood. they are complaining about the noise, the blocked streets and traffic. the board of supervisors passed the ban to keep vehicles with more than eight seats out of the area. the fines start at $100. >> where is john stamos when you need him? let's head to the beach. laura sent this video in today and in fact, she had a message for us. feels like june is when they

etched out in the sand. a lot of you enjoyed the beach. it felt like june. we had a new record of 7 and thanks for that video. we appreciate it. busting that old record set back 20 years ago, another record that we had today was in oakland. the record was set in 2009. right new temperatures are dropping off and plenty mid 60s throughout the board. what you'll find are averages will primarily stay in the low 70s but not quite as hot. the flow will begin to weaken a bit. average low 70s in the south bay and san francisco 70 and for the east bay 71. as you head throughout the day, you can see the 24 hour forecast will start off clear again at 7:00 a.m. in the south bay and peninsula and by noon, temperatures pushing the mid 60s, upper 60s expected in san

where is everyone going to park? thousands of parking spots across the street at the golf and tennis club. scott budman joins us to explain how the greens could help fans from skiing red? scott? >> that's part of a big deal where hundreds of thousands of dollars will be shared between levi's stadium and several nearby businesses in the name of getting you to the football games. who knew golfers could help football fans see their favorite sport? thanks to a new deal between the soon to open levis stadium and businesses, 10,000 new parking spaces will be open to 49er fans starting next season. opening up new places to park and new times to host football games. >> i know that there was some question whether that would happen or not? we confirmed that we have the availability to have parking and

she killed herself after three boys raped her, photographed her and humiliated her. there are questions about their punishment. in fact, it may have taken the suspects to go through the juvenile justice system than serve the punishment. the max may have been 45 days. nbc kris sanchez joins us live from the santa clara juvenile hall with more and that has to be a hard bill for audry's family to swallow. >> they are not speaking publicly because this is a matter supposed to be confidential because it went through the juvenile courts, just, but often juvenile offenders got a fraction of the penalty they would pay if tried as an adult because california law considers juveniles have the light to rehabilitation. >> you know, the district attorney doesn't always agree with all the sentences in every case, but we're subject to what

the standard practices are of the court and probation. >> reporter: the assistant d.a. super vices the county's juvenile justice system. he cannot comment directly on the boys punishment who admitted to sexual assaulting 15-year-old audrie potts and taking pictures of her naked body after drinking at a party in 2012. two of the teen boys adjudicated as juveniles, served 30 days in jauf nile hall each. the third's punishment was 45 days. as adults, they could have gotten ten years in prison but the assistant d.a. says california law puts rehabilitation over punishment. >> if there is a period of incarceration in any case, it has to serve a rehab purpose to send a message to the young man or woman they need to really

take the crime seriously. >> reporter: pott's family was told not to comment because juvenile cases are supposed to be confidential but he says as much as we strongly disagree and are actively trying to change the privacy laws for juveniles even when they commit hate acts on a minor, we cannot comment on the proceeding involving these young men. the assistant d.a. says he is working to make more juvenile justice cases open to the public while protecting the identity of the victims and accused but a criminal defense attorney that worked for santa clara university says it seems like a tough battle. >> i don't know how they balance that out but make it public. >> reporter: the pott family filed suit against the three boys and their families in civil court, also, the couple that

owns the home where the sexual assault happened, that case, again in civil court is pending. a rare occurrence, police are looking for two shooters. it happened at the executive in hotel. this is along 680. the victim, a man in his early 20s was found lie income a parking lot with a gunshot wound to the head. the shooting may be related to a party on the third floor of the hotel, it's the city's first homicide of the year. there was only one murder all of last year. the man accused of starting a fire at the chinese consulate in san francisco new year's day was back in court today. he appeared long enough to waive his right to a bail hearing. due back in court february 12th. he's charged with arson and willfully damaging property belonging to a foreign government for the january 1st fire at the consulate.

according to court documents, he said he committed the crime after hearing voices. an attack overseas on the deadly 2012 deadly benghazi attack. the bay area native twice refused to have a special operations team provide extra security in libya. three other americans were killed. >> i can't say that it was all preventable, and i don't want to say that. what i can say is that the security was inadequate and should have been beefed up. >> a local congresswoman, the report blames american diplomats and the cia for poor communication and lack security in the weeks leading up to the

deadly attacks. >> today marked the five-year anniversary as what's known as the miracle on the hudson. flight 1549 had just taken off from new york's laguardia airport when birds struck an engine and the plane lost power. danville native sullenberger said he would land on the hudson and he did safely, not losing one life. all 150 passengers and five crew members on board made it out. today the group gathered at the stop and raised glasses to a toast to life. >> without these people, my children would not have had a father. >> we have much to be thankful for. had even one person not survived, i personally couldn't have celebrated any of this. >> he is our own hero. the plane and it's story reconstructed at the carolina's aviation museum in charlotte, north carolina where flight 1549 was headed january 15th, 2009.

apple is refunding millions of dollars to some of it's customers. who gets the money? primarily parents whose kids purchased apps without their permission. apple will end up paying about $32.5 million after it received tens of thousands of complaints about unauthorized charges. the problem stems from how apple designed the app store to let users continue buying apps for 15 minutes after entering their password just once. some children using mobile devices were able to access the app store during that 15-minute period and ring up bills in the hundreds, even thousands of dollars. a conn artist from nigeria is accused of swindling half a million dollars from a woman he targeted on a dating website. according to the santa clara da's office, the 66-year-old woman met the suspect on christianmingle.com. it's a website. he wooed her with flowers and

more and asked her to invest. much of the money came from her retirement account and refinancing her home. police caught the man when he attempted to withdraw money from a turkish bank. he faces fraud and more in turkey. $200,000 was restored to the victim's account. a stock soared by 1900% but it may be mistaken i kdentity. on tuesday, nestor incorporated, the stock price shot up from two cents to five cents and trades uniter nest, the same name of the company bought by google for $2.3 billion. nest makes smoke alarms and smart thermostats. still to come here at 6:00, what a new study reveals about the secret to long lasting

here is an interesting tidbit, researchers asked people whether having children made them happier and found the answer was yes and no. the study of 5,000 adults found moms were happier than women who were childless, however, couples without children were happier than couples with children. they report being more ssatisfih

. on the heels of the prechristmas card security breach, a breach in the bay area. dozens of old navy customers had their credit card receipts with full account numbers and signatures sent to a random customer near buffalo, new york. marianne favro explains why and how. >> signatures of names. i didn't do through one by one, but when i realized what it was, i was like oh my gosh. >> reporter: what stunned her is what she received with clothing she ordered online from old navy, this envelope filled with hundreds of credit card receipts from bay area shoppers. all of the receipts appeared to be from this santa collar ray

store. >> addressed to me with my ship l label. when you open it, it was the bag of receipts and there is the date and inside is hundreds of credit card receipts, temporary shopping passes, account numbers, full account numbers. >> reporter: a spokesperson from gap blamed the problem on human error saying a package intended for company headquarters was accidently mailed by an employee to a customer. they were mailed from the santa clara store from shoppers. in a statement the company said we're in the process of reviewing store procedures to safeguard against this in the future. we apologize for the mistake and appreciate it was brought to our attention. anita wounders if enough is being done. >> i think all the people that are in here, should be notified. >> reporter: anita and her husband dropped off the receipts at an old navy store near buffalo. consumer fraud experts say

push ahead towards tomorrow will be the north bay averaging 50 where we still have some wind kicking around the bay, even five to ten mimles per hour at times. right across the bay, out of the west at three miles per hour helping to keep the fire danger believe it or not, on the increase with those lowering humidities. what we have happening is high pressure. this is something that should be here in july and august but it's setting up shop. it's not going to move too much, but just a little bit of movement as you head throughout tomorrow off towards the east. we think we'll help the offshore flow just enough. we have wide-spread 70s tomorrow and more records but not nearly as hot and the moderate to poor air quality. so when it comes to the dry weather we desperately need the rainfall and you can see for january in san francisco, we average the most rainfall all year long in january. so this month we have lost out on a huge section of wet weather and from here on out, it goes downhill when it comes to the

rain so really hoping for possibly some storms here as we head throughout february and march. there is a slim chance we could at least close to catch up at least for the rainfall season. as we get a look at the micro climate forecast for thursday, temperatures slightly cooler again with an offshore flow and 73 san jose and 73 redwood city and 70 san francisco. it will feel like mid 70s outside. we'll have wide-spread sunshine, large's jump from the morning to the afternoon will be the north bay. 32 in napa to start, 72 by the afternoon and for the try valley 72 with livermore at 71. the next largest change in that forecast comes as we head throughout saturday. a little on shore flow will bring back fog by the evening hours and temperatures in the 60s for san francisco, you guys. >> very nice. >> yes. >> thank you, jeff. 49ers football, that's the big buzz around town. the players and fans are getting ready and so are the mayors. we have a bet. you ready? san francisco mayor and his counter part in seattle wagering

seattle 12th man. andrea is in seattle with reaction but we begin with mindy balk has more on how quarterback colin kaepernick is preparing to defeat the demons in seattle. mindy? >> reporter: well, jim, colin kaepernick is the fourth nfl quarterback to ever win his first three post-season starts on the road. but kaepernick is 0-2 in seattle. kaepernick contends the regular season losses don't matter this sunday as the seattle seahawks and 49ers meet in the play-offs for the first time. >> it's a different game. it's a whole separate entity. for me, it's experience and comfort level with the offense and what we're trying to do, how we want to get it done, things of that nature. we haven't played when we went up there. they do have a good defense. we have to go out and execute. >> the big games, the big challenge, the big task.

russell wilson and his preparations for the tough 49ers defense. andrea? >> well, jim, the seahawks passing game has struggled of late. since the seahawks lost in san francisco, russell wilson has only thrown four touchdowns to three interceptions. the core of the seahawks offense is a running game with marshawn lynch but russell wilson plans on getting the passing game going again. >> i think we need to get better, and i think i need to get better first of all. one of those things, my confidence never wavers. every time i step in a play, a call is made, i believe it. we have a great passing game. we can do things on time in the money. we're explosive in the passing game, have been all year. we're in a great situation. we can do things, we're versatile and that's the exciting part about it. i'm always looking for a challenge. >> we played terrific teams and we've -- they have done a nice job on us and we haven't been able to take advantage. when we take care of the football and manage the game like we have been, that gives
